At HALE BALL MURPHY, PLC Carlson Baumgartner Murphy, PLC, our attorneys have designed a specialized consultation to educate our clients on the ins and outs of Medicaid and to develop a strategy to help preserve their assets. The consultation has three parts:

1. Information Collection. When you call us, an attorney or paralegal will ask questions about your situation. If we think you would benefit from a long term health care plan, we will send you a detailed questionnaire. Prior to your consultation, we will analyze how Medicaid rules will apply to your situation.
2. Strategy meeting. You and your elder law attorney will meet in-person to devise a plan for preserving your assets. You may have family members or others participate in the meeting. Your attorney will explain the Medicaid rules to you, focusing on those rules that are important in your situation. We will also discuss tax laws and other factors you should consider. Together, you and your attorney will develop a personalized plan, because one solution is not right for all of our clients. Your attorney will give you a written plan that summarizes the pertinent parts of Medicaid law and identifies the actions you should take next.
3. Implementing the Plan. For most clients, implementing the Medicaid plan will require the assistance of an attorney. There may be a deed or other legal documents to prepare. You may need to buy an annuity that meets Medicaid rules. We can work with you, your family and your financial advisor to take the steps needed to qualify for Medicaid.
