Protective orders, commonly referred to as restraining orders, are designed to protect people from threats of domestic violence. These are often needed in the context of a divorce or annulment when emotions run high. However, protective orders actually cover a wide range of situations. Immediate Protection

Different levels of protective orders exist. The first is the emergency protective order. This is issued by a magistrate and is good for a 72-hour period. Often, these are issued immediately after the police arrive on the scene of a domestic violence call. Our lawyers can help you obtain an emergency protective order if you have not already obtained one. If the emergency protective order is in place, we can offer guidance on the next step: the preliminary protective order, which is good for an additional 15 days.

Within that 15-day period, a hearing will be scheduled. The other party has the right to dispute the protective order at this hearing in order to protect his or her interests. However, the judge can ultimately expand the duration of the protective order for up to two years.

Protective Orders Are Not Issued Lightly

While emergency protective orders are relatively easily obtained, long-term protective orders are not issued lightly. They seriously impede a person’s liberty and property rights. The person on the other side of the order may not be able to return to his or her house. Relationships with children are impacted. However, if this is a necessary step, we will help you take it.
