Understanding the Factors That Determine Residency in Virginia Family Law Cases
Under Virginia law, one of the spouses must have lived in the commonwealth for at least six months and intend to remain a resident. In addition, if a service member who claims legal residency in Virginia has been deployed, he or she can file for divorce with the Virginia court. People who are stationed in Virginia can also file their cases here.
If a servicemember’s spouse files in a jurisdiction other than the servicemember’s home, that jurisdiction’s court may hear the case with the consent of the servicemember. Our attorneys understand the importance of residency issues in the context of a divorce or other family law matters. In every case, we use our considerable experience and skill to help our clients reach the best possible result.
