Common Law Marriage Attorneys in Northern Virginia
Prince William County Cohabitation Agreement Lawyers
Under Virginia law, an unmarried couple must obtain a marriage license and go through a wedding ceremony in order for the marriage to be valid. It is not possible in Virginia for a couple to form a common law marriage; one in which the couple gains marital rights by living together for a specified period of time.
Virginia law does, however, recognize common law marriages that were legally formed in another state. Couples who have met all the legal requirements for and been recognized as having a common-law marriage in another state will be considered a married couple under Virginia law.
When these marriages come to an end, the parties must go through a divorce like any other married couple. For common-law couples who have relocated to Virginia and subsequently seek a divorce, Virginia law will apply. Be sure that you seek the advice of a qualified Virginia family law attorney in order to give yourself the best chance of securing a favorable result.
