Hidden Assets in Divorce

Make Sure You Get Your Fair Share

In divorce and property division disputes, allegations of hidden income are not uncommon. At the HALE BALL MURPHY, PLC, our attorneys take pride in doing everything necessary to get a clear and complete picture of the financial situation. Not only does this help to ensure a fair division of property, but it also plays a role in child support and spousal support. With decades of experience, we know how to cut through any attempts to hide assets. We also know that divorce often comes during times of financial distress. Unfortunately, assets are often not being hidden. They have simply been exhausted by the time of the divorce.

Discovery of Hidden Assets – The Process

Three tools are used during the discovery process to obtain all of the necessary financial information and find hidden assets: interrogatories (written questions to be answered under oath), deposition (verbal questions to be answered under oath) and production of documents (requests for documents such as income information, tax returns or credit card statements). Through this process, we get a list of all assets, bank and investment accounts, businesses and business interests, real estate holdings and more.

Further Investigation of the Financial Situation

Spouse Hiding Assets During Divorce

If your spouse fails to provide everything, we may have to dig deeper. Perhaps the information we obtain during the discovery process leads to more questions. Is there income reported that is not accounted for? Is there no indication of where dividends are going? We can subpoena banks and other businesses in order to get financial records and information. In reality, it is extremely difficult to truly hide assets from an attorney with the experience and the tools to get all of the information necessary to produce a fair outcome.

Our attorneys can assist with any legal needs that may arise from a divorce, including divorce litigation itself, asset division, and name changes. Contact our attorneys today for legal aid.
