Father’s rights during a child custody case

Our topic of conversation last week was some of the factors that are considered in Virginia child custody cases. It is important for all parents who are going through a divorce to learn about those factors so they know just what the court will look for when awarding custody.

There is a common train of thought that the mother in the case will always have the upper hand in child custody cases. That, however, is far from the truth. Just this week, Chris Bridges, better known as the rapper Ludacris, was awarded full custody of his 13-month-old daughter by a judge in another east coast state. While that might seem odd to some people, it is evidence that fathers have just as much of a right to full custody of their children as the mothers do.

With that case in mind, we want fathers to consider some very basic points about their actions in a child custody or divorce case. One obvious error is that fathers don't always hire an attorney. While that might save money in the short term, it can provide devastating in the long term. Don't sign anything or agree to anything until you have spoken to an attorney.

Another mistake some fathers make is not taking action. Fathers might move out of the family home because they feel they have to. That, however, isn't the case. You have the right to be proactive. You have the right to stand up for yourself and your children. Don't just sit back and think that your ex-wife has all the rights and you have none. With all of that in mind, we encourage you to keep your fight and all aspects of the divorce private. Remember that social media sites are public and what you say might be used in court.
